SAGRILAFT for factoring companies supervised by Supersociedades

Factoring companies supervised by the Superintendence of Companies (Supersociedades) must implement full SAGRILAFT (Colombia's AML/CTF self-control and comprehensive risk management system) by virtue of their activity alone. Section 9.5.8 of chapter IX of the Basic Legal Circular (CBJ) requires it, with no revenue or asset threshold. External Circular 100-000020 of 2026 renamed SAGRILAFT the «Sistema de Autocontrol y Gestión de Riesgos LA/FT/FP y C/ST» (Self-Control and Risk Management System for money laundering, terrorist financing, proliferation financing, corruption and transnational bribery) and added the Business Transparency and Ethics Program (PTEE) to it.

A factor buys invoices and other receivables before they fall due. If the instrument is fake or the funder's money is illicit, your company becomes the laundering channel. That is why Líderes APLA reviews every link in the chain: the invoice, who endorses it, who must pay it and who funds it.

  • Invoices that appear fake, do not reflect a real transaction or are inflated.
  • Companies in the same group that invoice each other and discount invoices that are never paid.

A factor that breaches article 8 of Law 1231 of 2008 becomes subject to grounds for dissolution. Fines reach up to 200 monthly minimum wages (Law 222 of 1995, art. 86, sec. 3) and are calculated in basic value units (UVB) (Law 2294 of 2023, art. 313).
